In a recent article, the Financial Times highlighted that the Financial Conduct Authority (FCA) announced its investigation into banks’ practices of requiring personal guarantees from directors of small businesses.
This response comes following a ‘super-complaint’ by the Federation of Small Businesses (FSB). The complaint highlighted the burdensome demands imposed on business directors.
The FSB’s complaint shed light on the detrimental impact of excessive personal guarantees, which often force business owners to put their homes or assets at risk unnecessarily. Such demands act as a deterrent to business growth, inhibiting owners from accessing vital finance to expand their ventures.
While personal guarantees facilitate access to finance, they can leave directors vulnerable to significant personal exposure in the event of business insolvency or missed payments.
The consequences of activating a personal guarantee are dire, with lenders having the authority to pursue individuals for the entirety of the debt owed, along with accrued interest, default charges, and legal fees.
When faced with a called-in personal guarantee, directors risk legal proceedings that could result in charges being placed on their residential properties or, in many cases, bankruptcy. This underscores the importance of proactive measures to mitigate such risks and protect personal assets.
